That looks like a Golden Silk Orb Weaver to me. Harmless afaik and they just hang out in their webs.I had one that lived on my house for almost a year by my garden. She laid a clutch of eggs, but I don't think they ever hatched.

IIRC they lay their eggs even if the eggs were never fertilized
