Yes. If you are intelligent and creative enough to program a game, you can come up with your own concept for it.
I does look like a clone of Dave the Diver, but that's not necessarily a bad thing (depends if the experience has its own feel).
After the release of Doom, we did have many clones, but arguably many of them offered their own perspective (HL1 came out a mere ~5 years after the original Doom).
They even copied the look of the chef. There is a difference between making a game in the same genre and just straight up copying another one.
