Depends on the state. Illinois eliminated cash bail in 2023. You're only held pending trial if you're a threat to the community or a flight risk (to be determined at a hearing by a judge). A few other states have made changes to their bail laws to reduce the number of arrestees who are required to post cash bail as well.
